1. Agreement to Terms
By accessing or using Aryavart Digital Technologies services ("Service"), operated by Aryavart Digital Technologies Private Limited (Jabalpur, Madhya Pradesh, India), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you ("User") and Aryavart Digital Technologies Private Limited ("Company", "we", "us").
2. Eligibility
- You must be at least 18 years of age (or the age of majority in your jurisdiction)
- You must complete KYC verification before accessing wallet, card, and transaction features
- The Service is not available in jurisdictions where prohibited by law, including OFAC-sanctioned countries
- You must provide accurate, current, and complete information during registration
3. Account Registration and KYC
- Account creation requires phone number verification via Firebase OTP or social login (Google, Apple, Facebook)
- Indian users complete KYC via DigiLocker (Aadhaar-based eKYC)
- Non-Indian users complete KYC via Sumsub (document + liveness verification)
- KYC verification determines your account tier and spending limits:
NONE: View-only access, no transactions
BASIC: Limited daily transactions (deposit, view balance)
FULL: Full access including withdrawals, P2P trading, card issuance
- We reserve the right to request enhanced due diligence (EDD) at any time
4. Services Provided
Aryavart Digital Technologies provides:
- Custodial Wallet: USDT, USDC, TRX, and POL storage on TRON and Polygon networks
- Visa Card: Virtual and physical Visa card for spending crypto at merchants globally, issued via M2P Fintech
- P2P Trading: Peer-to-peer crypto trading with escrow protection
- Synthetic Swap: 1:1 USDT to USDC swap engine (and vice versa) with float-cap safety
- Bill Payments: BBPS-integrated bill payments and mobile recharge (India)
- Crypto Gifts: Send crypto gifts via SMS or in-app links
- Savings Goals: Goal-based savings vaults
- Referral Program: Earn commissions and milestone rewards for referring users
- AI Assistant: In-app AI agent for guided transactions with safety controls
5. Wallet and Custody
- Aryavart Digital Technologies operates a custodial wallet service. We hold private keys on your behalf using AWS KMS (Hardware Security Module backed)
- Deposit addresses are unique per user per chain (TRON, Polygon)
- We maintain segregated hot and cold wallet infrastructure with drain detection and auto-halt
- Minimum withdrawal amounts and network fees apply to on-chain withdrawals
- Withdrawal processing is subject to AML screening via Chainalysis KYT and spending limit checks
6. Visa Card Terms
- Cards are issued in partnership with M2P Fintech under Visa program manager license
- Virtual cards are issued upon KYC (FULL tier) approval
- Physical cards are shipped to supported countries
- Card spending converts crypto to local fiat currency at real-time exchange rates
- Daily spending limits are determined by your KYC tier
- Cards can be frozen/unfrozen instantly via the app
- We reserve the right to decline transactions flagged by our fraud detection system
7. Fees and Charges
- Account creation: Free
- Virtual card issuance: Free
- Crypto deposits: Free (network gas fees paid by sender)
- Crypto withdrawals: Network fee + platform fee (displayed before confirmation)
- Card transactions: FX conversion fee as per your card tier
- P2P trades: Fee on completed trades (deducted from seller proceeds, displayed before confirmation)
- Synthetic swap: No fee (1:1 USDT to USDC conversion)
- Bill payments: Convenience fee as displayed per biller
- All fees are displayed transparently before transaction confirmation
8. Spending Limits
Spending limits are enforced based on your KYC verification tier:
- NONE tier: No transactions permitted
- BASIC tier: Limited daily transaction volume
- FULL tier: Higher daily limits across all transaction types
- Limits can be raised after a 24-hour cooling-off period
- Limits apply across all money-out channels (withdrawals, card topup, gifts, P2P, payouts)
9. Prohibited Activities
You agree NOT to use the Service for:
- Money laundering, terrorist financing, or sanctions evasion
- Fraudulent transactions, chargebacks, or payment reversals
- Circumventing security controls, KYC requirements, or spending limits
- Using bots, scripts, or automated tools to abuse the platform
- Creating multiple accounts to circumvent limits or bans
- Transactions involving illegal goods, services, or darknet markets
- Market manipulation in P2P trading
- Providing false or misleading information during registration or KYC
- Attempting to manipulate or inject prompts into the AI assistant
10. Account Suspension and Termination
- We may suspend or terminate your account if we detect prohibited activities, fraud, or AML violations
- Suspicious accounts are flagged for manual review; funds are held pending investigation
- Account recovery is available via phone OTP + email verification with a 48-hour security hold
- You may request account closure at any time; remaining funds will be transferred to a designated wallet after final AML review
- Data retention obligations survive account termination (see Privacy Policy)
11. Intellectual Property
- All content, design, code, and branding of Aryavart Digital Technologies are owned by Aryavart Digital Technologies Private Limited
- "Aryavart Digital Technologies", the ADT logo, and associated trademarks are proprietary
- You may not copy, modify, distribute, or reverse-engineer any part of the Service
12. Disclaimers
- Cryptocurrency values are volatile. We do not guarantee the value of your crypto holdings
- The Service is provided "as is" without warranties of any kind
- We are not responsible for losses due to blockchain network congestion, exchange rate fluctuations, or third-party service provider failures
- We are not a bank and deposits are not insured by DICGC or any deposit insurance scheme
13. Limitation of Liability
To the maximum extent permitted by law, Aryavart Digital Technologies Private Limited's total liability for any claim arising out of or relating to the Service shall not exceed the fees paid by you in the 12 months preceding the claim.
We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss.
14. Indemnification
You agree to indemnify and hold harmless Aryavart Digital Technologies Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
15. Tax Obligations
- Users are solely responsible for their tax obligations in their respective jurisdictions
- For Indian users, 1% TDS may be applicable on crypto transfers exceeding the yearly threshold as per Section 194S of the Income Tax Act
- We do not provide tax advice; consult a qualified tax professional
16. Governing Law and Dispute Resolution
- These Terms are governed by the laws of India
- Any disputes shall be subject to the exclusive jurisdiction of courts in Jabalpur, Madhya Pradesh
- We encourage users to first contact our support team to resolve disputes amicably
- Binding arbitration may be pursued under the Arbitration and Conciliation Act, 1996
17. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email and in-app notification at least 30 days before the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
